29, 2009
The Special Meeting of the
Doylestown Township Board of Supervisors was held at 9:00 a.m.
on Tuesday, December 29, 2009 at the Doylestown Township
Municipal Building, 425 Wells Road, Doylestown, PA. Members of
the Board of Supervisors in attendance included Chairman;
Barbara N. Lyons, Vice Chairman; E. Thomas Scarborough, Jr.,
Supervisors; Cynthia Philo, Barbara Eisenhardt and Jeffrey
Bennett. Others in attendance included Chief of Police; Stephen
J. White, Township Solicitor; Jeffery P. Garton; Director of
Operations; Richard E. John; Township Manager; Stephanie J.
Mason
Absent: Township Engineer;
Mario Canales
PLEDGE OF ALLEGIANCE
ANNOUCEMENTS:
Doylestown Township
Municipal Administrative Offices will be closed, Friday, January
1, 2010 for the New Year’s holiday.
The Board of Supervisors
Reorganization meeting is scheduled on Monday, January 4, 2010
at 9:00 a.m.
The Township Board of
Auditors Reorganization meeting is scheduled on Tuesday, January
5, 2010 at 7:00 p.m.
Doylestown Township
Municipal Administrative Offices will be closed, Monday, January
18, 2010 for the Martin Luther King holiday.
VISITORS/PUBLIC
COMMENTS:
Resident; Ms. Leslie Puida
of Cherry Lane voiced her dismay with Ms. Philo’s comments
towards Mr. Bennett firm’s current legal matters. Ms. Puida
believes he is innocent until proven guilty and Ms. Philo’s
remarks were unfounded and unwarranted. Ms. Puida was also
disappointed with the Board’s performance concerning the review
of the 2010 Budget. Although the issues were understandable, she
hopes the Board will reconcile their differences and move
forward with the approval.
Resident; Mr. Joe O’Malley
of Rogers Road suggested the Board allow Mr. Bennett continue
his role as member of the Board of Supervisor’s, but he excludes
himself from all financial matters dealing with the Township.
Resident; Mr. Joseph
Paternostro of Houk Road voiced his embarrassment with the
performance of the Board concerning the review of the 2010
Township Budget. Although Mr. Paternostro does not agree Mr.
Bennett firm’s current actions, he also believes Mr. Bennett is
innocent until proven guilty. Mr. Paternostro was particularly
annoyed when the Board did not consider Ms. Philo as the primary
delegate to the Tax Collection Committee.
MINUTES APPROVAL:
Minutes of December 15,
2009
Mr. Scarborough made a
MOTION to approve the December 15, 2009, Board of Supervisors
minutes, seconded by Ms. Philo.
Mrs. Lyons requested the
December 15, 2009, Board of Supervisors minutes be rewritten in
accordance to the Robert’s Rules and the latest edition of the
PSATS Magazine.
MOTION FAILS, 2 to 1 with
Mr. Bennett and Mrs. Eisenhardt abstaining due to their absence.
Minutes of December 1,
2009
Mr. Scarborough made a
MOTION to approve the December 1, 2009, Board of Supervisors
minutes.
MOTION FAILS, for a lack of
a second.
Resident; Mr. John Everett
of Turk Road ask for Mr. Garton’s input regarding the Robert’s
Rules of minute taking. Mr. Garton stated although the
Township is legally required to include attendance of the Board,
topic, vote and public comment in the minutes. It’s at the
discretion of the Board how the minutes are reflected.
UNFINISHED BUSINESS:
2010 Final Budget
Mr. Scarborough made a
MOTION to accept the Final 2010 Township Budget, seconded by Mr.
Bennett.
MOTION was ADOPTED 3 to 2,
with Ms. Philo and Mrs. Eisenhardt voting nay.
Resolution No. 1499 –
Fixing the Tax Rate for the Fiscal Year Ending December 31, 2009
Mr. Scarborough made a
MOTION to approve Resolution No. 1499 that the tax rate be the
same and levied to all real property and persons within the
Township, seconded by Mr. Bennett.
MOTION was ADOPTED 3 to 2
with Ms. Philo and Mrs. Eisenhardt voting nay.
Act 32 – TCC Delegate
Re-Appointment
Ms. Philo made a MOTION to
appoint herself as primary delegate for the Tax Collection
Committee with Ms. Stephanie Mason as alternate, seconded by
Mrs. Eisenhardt.
MOTION FAILS, 2 to 3 with
Mrs. Lyons, Mr. Scarborough and Mr. Bennett voting nay.
Mrs. Lyons made a MOTION to
have Ms. Stephanie Mason be appointed primary delegate of the
Tax Collection Committee, with a township resident as alternate,
seconded by Mr. Bennett.
MOTION was ADOPTED 3 to 2
with Ms. Philo and Mrs. Eisenhardt voting nay.
BILL’S LIST:
Mr. Scarborough made MOTION
to approve the December 15, 2009 Bill’s List, in the amount of
$100,548.51, seconded by Mr. Bennett.
MOTION was ADOPTED 3 to 2
with Ms. Philo and Mrs. Eisenhardt voting nay.
NEW BUSINESS:
Doylestown Township
Municipal Authority (DTMA) 2010 Budget
Mr. Scarborough made a
MOTION to accept the DTMA 2010 Budget, seconded by Mr. Bennett
Mr. John informed the Board
that the Municipal Authority is in good financial standing with
no changes in operations and two large projects scheduled in
2010. Mr. John noted the Bond Replacement Fund was amended to a
Repair and Replacement Fund in order to assure funds is
available when replacements are needed in the township.
MOTION was ADOPTED 5 to 0.
Support of Tax Collector
– Appeal with School District
Mr. Bennett made a MOTION to
approve a Resolution to support the elected tax collectors
cause, seconded by Mr. Scarborough.
MOTION was ADOPTED 5 to 0.
