The regular meeting of the Doylestown Township
Board of Supervisors was held at 7:00 p.m. on Tuesday, July 18,
2006, in the Doylestown Township Municipal Building, 425 Wells
Road, Doylestown, PA. Members of the Board of Supervisors in
attendance included Walter C. Berry, Chairman, E. Thomas
Scarborough, Jr., Vice Chairman, Barbara Eisenhardt, Barbara
Lyons and Cynthia Philo. Others in attendance: Jeffrey Garton,
Township Solicitor, Chief Stephen J. White, Chief of Police,
Mario L. Canales, Township Engineer and Stephanie Mason,
Township Manager.
Pledge to the Flag: The meeting opened with a pledge to the
flag.
Visitors/Public Comments: Ernie Gash told the Board that CB
South will be having a cross country meet on September 27, 2006
at Central Park.
Presentation: None.
Announcements:
Doylestown Township 2007 Budget Workshop meeting will be held on
Wednesday, July 19, 2006 at 9:00 a.m.
After discussion, on motion of Ms. Lyons, seconded by Ms. Philo,
the Board of Supervisors cancelled the regularly scheduled
meeting of August 1, 2006.
The next meeting of the Board of Supervisors is scheduled for
Tuesday, August 15, 2006.
Minutes Approval - Board of Supervisors Meeting– June 20,
2006.
On motion of Mr. Scarborough, seconded by Ms. Lyons, the Board
of Supervisors unanimously approved the minutes of the Board of
Supervisors meeting of June 20, 2006, as submitted.
Resolutions and
Commendations: None.
Correspondence: None.
WORK SESSION:
Solicitor: Texas Eastern Pipe Line: Mr. Garton told the Board
that in response to the public’s interest and the Board of
Supervisors’ direction, he filed a Notice of Intervention with
respect to the Texas Eastern Pipe Line proposal. He explained
that Solebury Township has also filed a Notice of Intervention
but he is not certain at this point if Buckingham Township has
filed a Notice of Intervention. He will keep the Board posted
as to any future developments in this matter.
Township Engineer: No report.
Police Chief: No report.
Township Manager:
PennDOT – Route 263 Reconstruction: Ms. Mason explained that a
letter was received from PennDOT indicating that it is making
progress on preliminary engineering for the reconstruction of
State Route 263 between Bristol Road and State Route 413 in
Warminster, Warwick, Doylestown and Buckingham Townships. She
explained that the reconstruction is to take place in 2009 and
that the township should monitor progress of the project in the
interim.
2006 Curb Bid: On motion
of Ms. Eisenhardt, seconded by Ms. Lyons, the Board of
Supervisors awarded the 2006 curb bid to Dimiglio Construction
as per Richard E. John’s July 17, 2006 memorandum.
Supervisors:
Mr. Scarborough told the Board that on July 22, 2006 a hazardous
waste collection day will be held at the Middle Bucks VoTech
School.
Ms. Philo discussed the
new legislation with respect to cable franchise. Mr.
Scarborough explained that the Township is negotiating a
contract which should be completed in late July. He said that
Montgomery County has negotiated a contract with Verizon and
Doylestown Township is using that contract as a guide. Each
Township must then adopt an Ordinance as well as execute the
agreement.
Ms. Lyons explained that
she and Ms. Philo attended a recent Board of Supervisors meeting
in Buckingham Township and as a result of that meeting they are
hopeful that Buckingham Township will allocate funds in its 2007
budget to assist with the costs associated with the Edison
Furlong traffic signal.

NEW BUSINESS:
Land Development Review
Extensions:
Callan Tract Preliminary Major Subdivision: (Location: Warden
Road) On motion of Ms. Eisenhardt, seconded by Ms. Lyons, the
Board of Supervisors authorized an extension of land development
review for Callan Tract Preliminary Major Subdivision until
September 30, 2006.
Land Development:
Knipe Tract Subdivision – Preliminary/Final Land Development:
(Location: 710 Edison Furlong Road): Mr. Garton explained that
the site contains approximately 2.438 acres. The plans propose
to subdivide the lot into two lots. Both lots are proposed to
have private water and sewer facilities. The plans propose to
construct a single family detached dwelling on Lot 2. The
existing residential dwelling unit on Lot 1 is proposed to
remain. Additional improvements include the replacement of the
existing septic system on Lot 1 as well as removing the existing
kennel. The site has frontage on Turkey Lane and Edison-Furlong
Road.A discussion was
held concerning whether to take the additional 35’ right of way
from the center line along Edison Furlong Road and the
additional 25’ right of way from the center line along Turkey
Lane for future road improvements. The consensus of the Board
was to take the rights of way.
After discussion, on motion
of Mr. Scarborough, seconded by Ms. Philo, the Board of
Supervisors authorized the taking of the additional 35’ right of
way from the center line along Edison Furlong Road and the
additional 25’ right of way from the center line along Turkey
Lane.
A discussion was held
concerning the formula for determining the fee in lieu of for
developments. Mr. Garton explained that where a minor
subdivision is involved it makes no sense to have certain
improvements installed since there really is not a set formula
in establishing a fee in lieu of but in a major subdivision the
fee would be on a dollar for dollar basis.
After further discussion, on
motion of Mr. Scarborough, seconded by Ms. Eisenhardt, the Board
of Supervisors approved the Knipe Tract Subdivision –
Preliminary/Final Land Development subject to the following
conditions which the applicant approved:
1. Receipt of all permits and approvals
from any agency having jurisdiction including, but not limited
to, the Bucks County Conservation District, PennDOT, the Board
of Health, etc.
2. Compliance with the Boucher & James
report dated 6/15/06;
3. Compliance with the Bucks County
Planning Commission Report dated May 17, 2006;
4. Applicant to pay a fee in lieu of
recreation for the one (1) new lot created pursuant to the
subdivision, which said payment shall be in accordance with the
Doylestown Township Ordinance. Payment shall be made at the
time of the funding and execution of the Development and
Financial Security Agreements;
5. Applicant to pay a $1,000 fee for the
new lot as an off-site traffic improvement fee, which said
payment shall be made at the time of the execution of the
Development and Financial Security Agreements;
6. Compliance with the Pickering, Corts &
Summerson review letter dated 6/12/06 with the understanding
that the Board of Supervisors granted waivers from the
provisions of Section 153-24 B(2)(a); Section 153-25 A(1);
Section 153-25 C and Section 153-26 A(1) of the SALDO, all of
which relate, respectively, to the widening of adjoining
streets, placement of sidewalks along streets, construction of a
bike path and curbs along adjoining streets;
7. Applicant to pay a fee in lieu of the
improvements waived in the preceding paragraph in the amount of
$5,000, which payment should be made as of the execution of the
Development and Financial Security Agreements;
8. Applicant to provide the program
documents for the subsurface drainage pits to the Township which
shall be reviewed and approved by the Township;
9. The Township will accept the
dedication of the additional right-of-way on Turkey Lane, and if
PennDOT does not desire the additional right-of-way along
Edison‑Furlong Road, the Township will accept same as well;
10. Applicant to post $3,500 in escrow with
the Township for potential drainage improvements to
Edison-Furlong Road along the frontage of the project. If the
improvements are not made by PennDOT on or before July 1, 2007,
the Township may make the improvements and use the $3,500 in
escrow to pay for same. If PennDOT does complete the
improvements, upon completion of those improvements, the escrow
shall be refunded to the applicant. The escrow should be
posted at the time of the execution of the Development and
Financial Security Agreements;
11. Payment of all Township expenses
related to the application including engineering fees, attorneys
fees and the like; and
12. Lastly,
funding and execution of Development and Financial Security
Agreements.
Knipe Tract Planning Module:
On motion of Mr. Scarborough, seconded by Ms. Lyons, the Board
of Supervisors unanimously approved the Knipe Tract Planning
Module.
Zoning Hearing Board:
Application of Michael and Deborah Neff, 207 Briarwood Court –
Request for a Variance: Ms. Mason explained that the applicant
is requesting a variance. After discussion the consensus of the
Board was to leave this issue to the Zoning Hearing Board.
Treasurer’s Report – June 28, 2006: On motion of
Ms. Lyons, seconded by Mr. Scarborough, the Board of Supervisors
unanimously approved the June 18, 2006 Treasurer’s Report.
Ms. Mason explained that the auditor is behind in
completing the audit due to the change in GASB 34 programs but
that it should be completed in the near future.
Treasurer’s Report – July 18, 2006: On motion of
Mr. Scarborough, seconded by Ms. Lyons, the Board of Supervisors
unanimously approved the June 18, 2006 Treasurer’s Report.
Bills List – June 28, 2006: On motion of Ms.
Eisenhardt, seconded by Mr. Scarborough, the Board of
Supervisors unanimously approved the June 28, 2006 Bills List in
the amount of $811,994.31.
Bills List – July 18, 2006: On motion of Ms.
Eisenhardt, seconded by Mr. Scarborough, the Board of
Supervisors unanimously approved the July 18, 2006 Bills List in
the amount of $243,529.59.
Announcements:
The Doylestown Township 2007 Budget Workshop meeting will be
held on Wednesday, July 19, 2006 at 9:00 a.m.
The next meeting of the Board of Supervisors is scheduled for
Tuesday, August 15, 2006.
